Call to Action – Stop the Vaping Tax

 


In an effort to increase revenue and expand Medicaid coverage to more low-income Oregonians, Governor Kate Brown has a package of taxes she is pursuing to generate more than $700 million dollars in new revenue. As part of this package, there are several attempts to tax vaping in Oregon.


House Bill 2123 expands the definition of ‘tobacco products” for the purpose of taxation to include inhalants from nicotine.


House Bill 2159 imposes a tax on the distribution of inhalant products based on the percentage of wholesales price.


House Bill 2270 increases tax on distribution of cigarettes and includes inhalants delivery devices in the definition of ‘tobacco products’ for the purpose of imposing a tax.


Regardless of which proposal is pursued, the goal remains the same- to target Oregonians who vape with a new tax.

As the owner of a vape shop in Oregon, the proposed taxes on vaping would significantly hurt my ability
to operate as a business in our community. Vaping products should not be lumped into the larger
definition of tobacco products. A UK study of e-cigarettes and heated tobacco products published by the
Public Health of England, found that vaping is 95% less harmful than smoking.


E-cigarette use among people in Great Britain who have never smoked, remains very rare at less than
1%, similar to the level of use of nicotine replacement therapy. Among never smokers who have ever
used e-cigarettes, a minority have used nicotine-containing liquids and the vast majority did not
progressed to regular use.


The fact remains that the most common reason for e-cigarette use continues to be in order to stop
smoking, and smokers who use e-cigarettes on average have higher motivation to stop smoking than
other smokers. Many clients are using vaping as a successful way to stop smoking.


Passing a tax on vaping and e-cigarette products would cripple their main purpose, to help cigarette
smokers stop smoking.


I urge your “no” vote on House Bill 2123, House Bill 2159, House Bill 2270.

I have been a smoker for most of my life. I had tried everything to quit the habit, from patches,
prescriptions, nicotine gum, and quitting cold turkey. None of these techniques were successful until I
came across vaping. The flavors made vaping much more appealing, and through using the varying
nicotine levels I was able to slowly put down the cigarettes and move to completely using my vape pen. I
would not have succeeded in quitting smoking cigarettes had it not been for my local vape shop. The
employees walked me through every step and genuinely wanted me to succeed in being able to quit.


Now as a vape shop owner myself, I know that passing a tax on the products I sell would significantly
cripple my ability to sell my products and stay afloat as a business.

Why we need Advocacy


Oregon Vapor Trade Association is a nonprofit organization representing manufacturers, wholesalers, distributors, and retailers of vapor products for the state of Oregon. We are a consortium of these member companies that share a vision of unity regarding state and federal level advocacy programs and tobacco harm reduction with emphasis on public education.
